Habeas data as a means of protecting the fundamental right to informative self-determination

Abstract

The present work considers Habeas Data as an autonomous constitutional process and not a kind of the amparo process genre, therefore presenting its own and peculiar morphological characters that make it worthy of a singular and individual normative treatment. It follows that the concurrence of the requirements for the constitutional process of amparo is not necessary to be able to use it. In addition, it is postulated that the legal right that it seeks to protect is that of informative self-determination, that is, the process in question has a precise and specific purpose that essentially consists of allowing the interested party to control the veracity of their personal information and the use of it. is made.
