The democratic concreteness of the administrative procedure

Abstract

The political-normative reduction of the principle of legality is undoubted;the Administration does not find in this standard an adequate limit for its power but a counterweight that prevents the free fulfillment of its final tasks, reason for which, the operative extension is redirected, at present, to legal-superior standards with the emergence of the principle of juridicity, which, within the essentially democratic, administered-Administration relationship, allows the projection of the essential purposes of the State towards the materiality of true collective needs.
