Health code and the role of health workforce: inputs for health professional role regulation change

Abstract

The COVID-19 pandemic affected the inclusion of health personnel in Book V of the Health Code through a bill that consolidates five parliamentary motions. In 2018, a working group was convened to update this legal body, from which a technical report was issued and delivered to the Executive to prepare a bill. However, this did not happen. There are four inputs to update this text: the current Book V, the technical report proposal, the Legislative proposal, and the Executive proposal through the indications of the Legislative Bill. These texts are analyzed in terms of their general content, definition of professional roles, and incompatibilities in the exercise of the profession. It is necessary to include and define the role and professional autonomy supported by a planned, quality workforce that appropriately addresses conflicts of interest, with a peri-urban strengthening of ethical control to respond effectively and equitably to the population’s needs.
