Trafficking in Human Brings for the purpose of Forced Marriage in the Spanish Legal System

Abstract

This paper analyses human trafficking for forced marriage in the Spanish legal system, and discusses the most recent legislative reforms of the Spanish Penal Code, in particular, the reform of 2015, responsible for introducing this crime in Article 177 bis, which defines human trafficking as an offence. To this end, it is examined not only the Spanish law but also international legislation regarding this issue, such as the United Nations Protocol To Prevent, Suppress, and Punish Trafficking in Persons, Especially Women and Children –which offers a definition of human trafficking, and establishes a set of criteria for a coherent and circumscribed framework in the fight against trafficking– as well as European Human Rights legislation and the law of the European Union.

Licenciada en Derecho y Máster en Derecho Público en la Universidad Carlos III de Madrid. Magistrada Suplente en la Audiencia Provincial de Ávila. Profesora asociada en la Universidad Carlos III de Madrid y profesora colaboradora en la Universidad Pontificia de Comillas. Su labor investigadora se centra, fundamentalmente, en el estudio de los derechos humanos de las personas que se encuentran en situación de especial vulnerabilidad, inmigrantes y víctimas de trata de seres humanos.
